So is Hostgator GDPR Compliant or not? Hostgator is, in fact, GDPR Compliant. Hostgator became GDPR Compliant on May 25, 2018.
In order for Hostgator to become GDPR Compliant, it entailed them to do a bunch of work “behind the scenes,” such as reviewing and updating their agreements, privacy policies, internal processes, features, and templates to make sure everything was GDPR Compliant.
What is the GDPR?
GDPR stands for the General Data Protection Regulation that will start being enforced on May 25, 2018. The GDPR was passed by the European Parliament to create a safer place on the web.
The GDPR is a data privacy law across the states of the European Union or otherwise known as the (EU). The purpose of the GDPR is to provide the EU residents rights over their personal data and how it is processed or used.
What is Considered Personal Data?
The GDPR defines personal data as, information relating to a person that can be identified, directly or indirectly, by reference to an identifier such as a persons name, identification number, location data, or online identifier, or to one or more factors specific to the genetic, mental, economic, cultural, physiological, physical or social identity of that identifiable person.
The GDPR notes in their privacy law that online identifiers can constitute personal data which are provided by the following: devices, applications, tools, protocols known as IP (Internet Protocol) addresses, Radio Frequency Identification known as (RFID) tags and Cookie identifiers, and similar web tracking technologies such as Google Analytics, etc.
How does this affect you?
Any individuals, companies, or businesses that provide services to residents located in the EU need to comply with the data privacy law.
If you collect personal data in the form of collection, processing, storage, or transmittal of the following data, you need to comply with the GDPR by May 25, 2018.
If you are an EU resident, the GDPR law will apply to your personal data that is in your Hostgator account.

What rights does the GDPR provide to EU residents?
If you are an EU resident you have rights to how your personal data is handled under the GDPR. Here are those rights with respect to Hostgator:
You have the right to access
Hostgator makes it easy to get access to your personal data information. If you or your customer is curious you can ask Hostgator what personal data is used, why it is used, and where the personal data information is used.
Your right to rectification

Hostgator permanently deletes your Hostgator account information when you cancel services with them.
Your right to restrict processing
If at anytime you, or your customer, believe your personal information in regards to data is inaccurate or has been collected in an unlawful manner, you can request limited use of your personal data with Hostgator.
Your right to portability
Hostgator makes it easy to move your Hostgator account data over to a third party at any time you would like.
You have the right to object
If you, or your customer, decides for some reason that you no longer want to allow your data to be included with Hostgator’s analytics or for Hostgator to provide personalized marketing content, you can contact Hostgator at any time to request removal of this data.
Hostgator provides the necessary procedures so that they can comply with requests that you might have, and support you in completing any GDPR requests that come from your customers.
EU Consumer of Hostgator Services?
Most of the time, Hostgator is the controller in relation to your personal data that you provide to them as a customer.
Starting May 25, 2018, Hostgator will no longer publish the personal data information in regards to domain info in the WHOIS directory for EU residents.
Hostgator does this so that their WHOIS output is compliant with the GDPR law. Access to personal data in regards to domain name registrants could be granted when access is necessary for technical reasons like transfers, or for law enforcement when it’s legally entitled to receive such access.
Business owner that has EU customer data?
In some instances, you might be acting as the controller of data information. An example of this is when you are collecting information from either your contacts or email subscribers and that is uploaded or transferred into your Hostgator account.
You’ll have some additional obligations to comply with the GDPR. Make sure you properly understand what you need to do to comply in this instance.
Hostgator’s terms of service require you to obtain and process personal data lawfully and in a proper manner. Make sure you are doing this so you are compliant with the GDPR.
